Searches Of Student Property

Policy

It is the policy of Hampton Academy that no student may possess alcohol, controlled, dangerous substances (CDS) or weapons on Hampton Academy property. If a student is found to be in possession of a CDS or a weapon, he/she shall be subject to disciplinary action. Parents/guardians will be immediately notified by the Director or his/her designee. A search may be deemed permissible when the measures adopted to conduct the search are reasonably related to the objectives of the search and are not excessively intrusive in consideration of the age and sex of the student.

Purpose

It is Hampton Academy’s responsibility to protect the health and safety of its students and its staff.

Procedure

If a staff member has a reasonable suspicion that a student is in possession of alcohol, controlled, dangerous substances (CDS) or weapons which would constitute either a danger to another, a violation of the law or the rules of Hampton Academy, the following procedure will take effect.

  1. Student will be escorted to the Director’s office or his/her designee.
  2. This search may encompass the contents of items located within a student’s backpack, purse or pocket.
  3. At that time, the student will be questioned and may be requested to empty her/his pockets, empty the contents of her/his purse or empty the contents of her/his backpack by a school official.
  4. In the event that a CDS or a weapon is discovered, the student’s parents or guardian will be notified, and the student will be subjected to appropriate disciplinary action. Law enforcement authorities and the district case manager will be notified immediately.

Staff members are required to follow the appropriate policy:

  • Suspicion – Under the Influence of a Controlled, Dangerous Substance
  • Suspicion – In Possession of a Controlled, Dangerous Substance
  • Suspicion – Transmission and/or Sale of a Controlled, Dangerous Substance
